In a divorce can I request arrears for medical insurance and daycare?
We are in the final stages of a divorce. I asked my attorney if I could request arrears for insurance on the children and daycare costs. She said no my STBX would have to agree to it first. This make no sense of course he will not agree to it. If he did we wouldn't have an arrears issue.
So here is my situation. Filed for divorce over a year ago. My attorney would not report temporary orders next to the courts. I want to request arrears for 50% of all the medical premiums and daycare expenses that I paid for our children. Has anyone have this happen? Can I petition the court for arrears? He is also behind contained by his child support payments and my attorney said the court would take care of that situation.
So what do you give attention to? Can I request this from the courts? Its around $5000 that he should have sent over the past year and I involve it to pay my attorney. We used up the retainer a looong time ago.

Your attorney was right when they said he would enjoy to sign and agree to that change. Why has it taken a year to catch a divorce ? Sign an agreement and get it over with. Yes , the court will switch the arrears in support but he has to hold a way to pay. Sign an agreement...
You can ask for anything but he doesn't have to agree. I reckon you're stuck with the bill.

Why within hell would your lawyer not file temp. instructions?? That is routine, especially when children are involved.( I'm not feeling very dutiful about your attorney.)
