A girl rear-ended me, and she is refuse to brand name a statement. Can her insurance co. claim no liability?

She refuses to make a statement to her insurance company, and they hold claimed that if she doesn't make a statement to them, they will not admit show disapproval even though it was clearly her fault. Can they do this?
Answers:
Your insurance company should sort it out. That's why you pay your premiums.
Yes they can. If there were a police report corroborating the facts of the coincidence, you would have more of a case. But if she refuse to cooperate, they have no choice but to deny coverage. Your only recourse is to jump through your own carrier, if you have collision coverage, they will nick care of your needs and later pursue the responsible party for repayment of your deductible. If you don't have collision coverage, you can profile suit against her. I think either style, whether she gets a big fat bill contained by the mail, or she receives a summons to court, she will changeover her mind rather quickly nearly not admitting fault.
Since you dont hold any insurance coverage on your vehicle, your insurance company has no interest or obligation to work for you because you did not take-home pay any premium for coverage to your own vehicle (collision coverage).

The only recourse you have is beside the other driver, or the other driver's carrier. However, if the other driver refuses to cooperate beside his/her insurance company, the company can deny your claim due to the driver not complying with the terms of his/her insurance contract (failure to cooperate surrounded by the investigation of a claim). When the insurance company denies your claim, you must attempt to recover money directly with the driver that hit you. Usually, a lawsuit served to the other driver, will gain his/her attention and they will then turn it over to the insurance carrier for handling and establish they better cooperate or cough up the repair cost out of pocket. Call your agent, that's what you're paying them for. I think what's she's doing would be not permitted in some states. In California you're supposed to call your insurance company as soon as you can.If you call and she didn't, it's going to make her look guilty.
How much damage is in that to your car ? You can also try small claims. If she refused to show up surrounded by court, you would win by default. You can have her wages garnish.
If you own collision coverage on your policy, your insurance company should be helping you with this. If haven't already, call them and agree to them deal with the other company.
If you own liability coverages only a police report stating the other driver was at slate should be enough. Source(s): Insurance Agent
They can try but they won't achieve anywhere with it. Just file everything as you usually would. Was there a police report (that would help abundantly if there was)?

I would make sure adjectives your bases are covered with the paperwork and reporting, though, incase they try to verbs something sneaky.
She has to explain the accident to them There be a collision involved- I would not be intimidated by them. Threaten them with your attorney and have them SIGN a statement saw they are not going to investigate the claim- Call the insurance commissioner in your state- Light a fire under their ****! LOL
