Are Insurance companies allowed to embezzle up to 30 or more days to determine liability?

I have put a claim in a week a ago, and zilch has been done! I put the claim surrounded by through allstate which is the violate-rs insurance. My car was T-boned. The guy run a stop sign and hit me. Well the adjuster came out friday to see it an give me the estimated damages. Its immediately Tuesday and they say they are still trying to determine liability ( who's at fault ) It will be 1 week tomorrow. i be a sign of i didn't drive sideways into his car..Should i get a legal representative involved? Im getting frustrated because my car is not drivable, an they have not issued me a rental vehicle until they determine liability...Please help!
