As far as I'm aware passengers are covered no event who's at fault? Thats what its like within the UK. You should claim off your daughters friends insurance.
This depends on what state you are in.

In some states, your daughter can file the claim lower than YOUR auto policy, under the medical payments/pip coverage, whatever it's call in your state.

In most states, if your daughter's friend is at fault, later your daughter can sue her, and there SHOULD be coverage under her liability partition, as well. Lastly, although you state the daughter's friend had liability one and only, MOST states also require some medical payments coverage - you can see if there was any, that would be salaried under her policy.

Again, coverage varies by state, but it's outstandingly likely that YOUR medical payments would cover your daughter, if the friend's policy doesn't have medical payments coverage, assuming your daughter lives within your house.
Then file a claim against the auto policy for the motor your daughter was riding in. If your daughters friend be at fault, then your daughter would enjoy a claim under her liability coverage.

Your daughter was not driving one of the cars. As such she have a liability claim gainst the at fault driver. That could be the Allstate driver, your daughters friend or both.

Since Allstate denied the claim, file against your daughters friends policy and see what they establish to do. Source(s): Insurance Adjuster
~~If your daughter does not hold health insurance then save for paying all the costs, you will have to record a personal injury claim against this girlfriend, or whoever owns the car.

You can see a personal injury attorney. They usually work on contingency, meaning they will appropriate a percentage of the settlement your daughter receives, so no out of pocket costs to you. At least your daughter will not own to cover the medical bills, which is definitely not her responsibility to do.~~
your daughter as a passenger have no fault in this calamity.

allstate has denied liability, claiming that your daughters friend is liable in this disaster.

your daughter does not drive and has no auto insurance, but do you have auto insurance?? even though contained by college, some auto insurance will cover your daughter. call them and inquire.

do you have strength insurance? if so, file the medical bills with them to be compensated if she is covered under your health insurance.

own you filed a claim with your daughters friends auto insurance? she may enjoy medical payment coverage and/or pip which may pay your daughters medical bills to the decrease of the policy.

liability coverage pays for damages to property and injury. since allstate states not liable and the friend is liable, you will have a bodily injury claim with her company.

but, depending on where on earth you live, state statute may preclude you from collecting. some states have a "thresshold" meaning the extent of your daughters injuries own to meet;
ie; serious injury, loss of limb, scarring etc.

also underneath certain states, may have trustworthy negligence statutes that could bar any recovery.

telephone the daughters insurance and pose the questions.

1; ask about medical expenditure coverage and or/pip
2; ask if they are accepting liability?
3; if so, is she eligible for a bodily injury claim?

if no to all of the above, then you might want to contact a advocate for your legal rights in this calamity.

otherwise you maybe on the hook for all the medical bills.

flawless luck
You need to post the details of the accident to draw from some opinions on if the accident be your daughters friends fault or not.

You might contact the Department of Insurance in your state for relieve. A link is below. Just click on your state. Source(s): https://www.aipso.com/links.asp
The other party's insurer is refusing to admit "at fault" accomplishment on their driver's part. You can try to get her friend's insurer to foot. If they won't, your only option is to sue any her friend or the other driver as appropriate. In the meantime, you have to front the money for the medical claims. Do NOT make the mistake of refuse to pay the medical bills because "it wasn't her fault." YOUR credit (or hers) will suffer regardless.

My wife have exactly the same experience except that it was clearly the other driver's blame. We had to threaten to sue the other driver to get his insurer to cough up the medical costs. Source(s): Experience.
