(Auto Insurance) Liability - Guy that hit me charged guilty for thoughtless driving.?
When I lived in Red Deer, Ab I was involved within an accident; I was clearing an intersection on a washed out light. Since the weather was horrible that daytime it seemed like the driver coming through the intersection didn't want to stop, and T-boned the front failure of my vehicle.
We have both filed a police report already and I lost my vehicle because I didn't enjoy collision on my insurance policy, my insurance rate also went up because I should have yield to oncoming traffic. It has been four months since the incident and I've moved to Calgary.
Just today the RCMP phoned me and told me that I obligation to appear in court because the driver that hit me is being charged for unwise driving.
QUESTION: If he is charged guilty, does that mean I'm not longer liable for the accident? Also, should AMA lower my insurance rate to what it be before the accident and does his insurance company enjoy to replace my vehicle since he is guilty?

I don't know the law where your at. But if you had the right to travel through the yellow light, after the accident is not your fault. In CA you are allowed to run through a yellow light. So, you would entail to post if its legal where you are at.
