SOMEONE RAN A RED LIGHT AND WE HIT THEM. THE INSURANCE IS NOT ACCEPTING LIABILITY, WHAT CAN WE DO?

SO, BASICALLY THEY RAN A RED LIGHT AND WE STRUCK THEM AT THE INTERSECTION. SHE GOT CITED FOR A RED LIGHT VIOLATION AND THE POLICE AT THE SCENE SAID SHE WAS AT FAULT. WE GOT AN ATTORNEY AT THE CHIROPRACTOR AND THEY ARE LITTLE HELP. ITS BEEN OVER 30 DAYS AND HER INSURANCE IS NOT ACCEPTING LIABILITY FOR THE ACCIDENT. OUR PARALEGAL ADVISOR IS SAYING THAT THEIR DRIVER HAS STATED THAT WE WERE THE ONE THAT RAN THE RED LIGHT. HOWEVER IT CLEARLY STATES IN THE POLICE REPORT THAT SHE GOT CITED AND ALSO INCLUDES HER CITATION NUMBER. I DON'T KNOW HOW OR WHY SHE WOULD MAKE SUCH STATEMENT WHEN THE EVIDENCE IS IN THE POLICE REPORT. WE ALSO HAVE A WITNESS, BUT HE HAS NOT RESPONDED TO OUR CALLS. WHAT CAN WE DO? WE HAVE AN ATTORNEY, BUT HE IS LITTLE HELP. HE ADVISES US TO CALL THE INSURANCE COMMISIONER. THIS HAS PRO LONG FOR TOO LONG. IS THERE ANYTHING ELSE WE CAN DO?

Why are you dealing with this? Let your insurance company business with it, that's why we all buy insurance.

Kind of sounds resembling you don't have insurance, so, depending on where you live you may be found to a degree at fault. If you live in my state and didn't record the correct accident forms to the state, you could also be cited and fined, as well as lose your license.
If it states within on the police report your fine. As far as insurance goes I would let the insurance companies fray it out. Your company will see it was there guiltiness and won't pay them. That's what insurance is for... but again I would let your insurance company argument it out. If your company makes your insurance go out start looking for another company. My personal feelings, I use Statefarm and they are the best I have ever had. I hold had Allstate and progressive.
The citation is meaningless because the officer did not witness the chance. The police report is also meaningless for the same reason. Neither can be submitted as evidence within court because they are both based on hearsay, which is not admissible in court. If the officer be called as a witness the only piece they would be able to testify is to what they saw when they arrived at the scene. They wouldn't be able to contribute any evidence whatsoever about how the accident happen because it would all be based on hearsay and speculation. The insurer know this which is why they are backing their client's position that she did not run the red light. The best point you could do at this point is have your insurance company take over the claim and own them argue with the other insurer.
i have the same problem once before i in reality got a copy of the police report and faxed it to the other person's insurance company because once cited they cant deny the complaint especially if it went through court already.
You need to drop that lawyer of yours. Sounds worthless....

Get a copy of the report, give an account the insurance company you have it, so, pony up so you don't have to travel to court.

Then if they don't pay, go to an attorney that will filch your slam-dunk case. When you win, you are entitled to reasonable fees and expenses to bring suit.
