How to argue near own insurance, against rate increase, and ask for deductible fund?

We went to another body shop and get a much higher quote, basically due to some frame overexploit not noticed during the first estimate. So, we just contracted to go with insurance appointed body shop to fix that. Since the front factor is not severe at all and it is subject to the $500 deductible, we just asked to fix the flipside part which I believe the third driver (car behind us) is responsible for that. The adjuster after notified me that the newly notice damage on the back would explanation the car to be totaled. So it ended up the coupé was totaled and we got a check and bought motor back at 1/4 of its value.

After a couple of month, I found that our company messed up. They just got money back from the other insurance base on the 1st estimate (around $600) although they should have got much more money (~$4000) . They said they would submit spanking new information to the other company, but actually nothing happen after another 2 months. The consequence of this is that they blamed me for the cost and increased my rate by $200 for half a year. They said it could change when suitcase closed. Just got a letter proverb it is closed and they didn't recoup the money. That is definitely excessive to blame me for their mistake. I'll call them tomorrow. Just wonder what to do if they insisted that there are nil they can do now. File a small complaint at local court?

For the deductible, I haven't got my $500 rear. I think we should get it rear. It is true that we were partially at blame, but we didn't ask for the repair of the front part where we are at shortcoming. What I understand is that the deductible applies when and only when we want to repair our vehicle where the damage is due to own mistake.

You don't get your deductible back on your claim, until/unless your insurance company get it back from the guy at fault for the catastrophe. This can take up to six months. The deductible applies ANY TIME your insurance company pays out on your behalf. You can't divide damage between "our show disapproval and not our fault". You need to put the supplemental claim in beside your insurer for the FULL damage, and the deductible WILL apply to the front end vandalize, even if you don't repair it.

Your insurance needs to put in a supplemental subrogation claim, IF THEY CAN. With four cars, it's notably likely that this guy didn't have adequate insurance to cover damage to all four cars, goal you don't get your deductible back.
