2. Then you would have to be capable of show that they were worse drivers than all drivers.
3. Then you would hold to show that they are worse drivers BECAUSE they are Asian.

For 1, fitting luck. Japanese? OK. Filipino? Indian? Pakistani? Azerbaijani? Turk? Did you know that the US census does not even have these notes? People mark for themselves whether they are Asia or Pacific Islander. How can you trust that? Why should you?
For 2, it would be difficult to show. Total accidents, accident by age, fatalities, accidents per miles driven, accidents per year. All those information would have to be compiled and analyzed. It is unlikely that they would show what you want them to show.
For 3, forget it.
For 4, you will never ever get this far. If my mom is Asian but my dad is not, my baptize will be non Asian. Something like 3 in 10 individuals in the whole world are relatives of Genghis Khan, but obedient luck proving it either way.

And if you do carry that far, the Supreme Court will knock it down. And the difference in driving ability, if any, compared to the costs and problems of instituting such a system, is potential to be small. No cost benefit means no policy, definitely.

Finally, if Asians do own more accidents, it does not necessarily mean that they report them as much as run of the mill people.
