Semi-det house, shared chimney stack rendering broken insurance co. debris claim neighbour refuse settle up Ideas?
Damage is on westerly side - bad weather area, rainfall has got within then frost has expanded 'blowing' rendering rainfall seeping into roof space above internal ceiling. Neighbour doesn't want her 'side' done! How can rendering be removed and only partly repaired. What is legality in getting neighbour to share costs?
Answers:
You need to look at your deeds as in that may be provision for just such a thing to be found therein. However, it is other going to be difficult to get your neighbour to spend money as they may not have it to spend. Ask your neighbour if you can do the repair and pay cheque for it yourself.
Sounds like you're gonna end up getting a solicitor involved - might want to get hold of advice now.
You might suggest to the neighbour that you will own your side of the stack done and should any damage occur as a result of her refusal to complete her side, you will form a claim against her. Not the best solution but as you cannot 'make' her do what is right, you might just persuade her using the dash 'While the builder is up there, the labour charge can be halved'
Picking out the out-of-date mortar is not difficult but it really is better than 'patching up'
I'm not a builder.
Firstly check your deeds to see if neighbour shares unified repairs, if not just speak to her pointing out the need of the repair. Try saying if this work is not done the chimney stack could fall cause thousands of lb's roof damage. Good Luck.
hold you contacted your insurance company to see if your buildings cover will cover some of the cost of the repairs.
and as a second thought maybe the council to tell them that the chimney will become chancy if not repaired. she will have to sort it or the council may do the repair and charge her. but you should check that.
she has to pay. carry some one to knock it over forcing her to share the cost of a new one
