if someone falls on ice in the drive path of someones home and breaks there leg(9 srews and a plate) will there home owners pay cheque any thing?

Yes. However, I believe the homeowner still pays the deductible and their insurance will probably run up because it is their responsibility to make sure ice and snow is cleared from their driveway.

There are two coverages that could come into play.

Medical Payments Coverage: pays for medical bills (up to the policy limit) for folks who are injured on your property and are not residents of your house hold. It does not matter if you be negligent. This coverage helps next to medical bills only. It does not pay for pain/suffering or lost wages.

Liability Coverage - pays for injuries that start on your property and are caused by your negligence (up to the policy limit). People who qualify for coverage under this policy, would also enjoy a viable civil suit against you (since your negligence caused their injury). This coverage gives consideration for medical bills, lost wages, pain/suffering. If a character qualifies for Liability coverage - they will also be able to collect beneath the Medical Payments Coverage. Liability Coverage has a higher restrict than medical payments.

We can't tell you if the person would enjoy a claim under the Liability. That depends on what happened and the law of your state. As long as the injured person is not a resident of your house hold and was injured on your property - they should hold a claim for Medical Payments.

This type of claim can be very tricky and need to be investigated by the insurance company outstandingly soon after the accident.
