Insurance claim - Home mar - My rights?
Our house got hit by a tree on 9-14-08. The adjuster came out and give us a check for $40K within 4 days of the incident. a week later we have three contractors price the repairs and they came in at $100K-$125K. The insurance company sounded outraged. They hold had the estimates for nearly three weeks and finally got around to bringing out "their" contractor to do an estimate. If their contractor prices it lower than my contractor, can I still receive the money to use my contractor or can they claim that their contractors number represents the actual value?
Also, since they low balled their initial estimate and have be absolutely terrible, do I own a case for Bad Faith Insurance?

You don't have a fruitless faith claim yet. Heck, that's hurricane Ike. I lost my house contained by Galveston, and haven't seen a check or an estimate yet. When a company have 20,000 claims come in all at once, it can appropriate a few months to settle.
You need detailed quotes, to see what the difference is in pricing. If your insurance company is paying $100 an hour for labor, and your contractor requests $300 an hour for labor, you're not going to get the insurance company to pay for scalping labor.
Also, you don't mention if there's a coinsurance problem. You don't mention the total cost of your house to be rebuild, and you don't mention how much insurance you have on the house. If you only in part insured the house - ie, if you have $100,000 on a $200,000 (COST TO REBUILD, not market value) house, you've get the house half insured, the company will pay partially the claim, up to your policy limit.
