A drunk driver hit my parked saloon. Does his insurance wage for it?

He was drunk and hit my parked car. The police be called and they took him to the station and interviewed him (I dont know any more) and im waiting for the police report.

If he is insured will his insurance pay for my damages? My vehicle is pretty much totalled.
Answers:
It certainly ought to
Assuming he is insured yes and if you are fully comp your excess. They may very well refuse to pay for his repairs and could sue him for their outlay if he be drink driving. If you are fully comp I would let your insurance deal beside it after all that is what you are paying the premiums for you mighr as very well get them to earn them
Providing he has insurance then his insurance company will reimburse for the repairs/ replacement vehicle. They can't get out of the third party liability screened-off area even if the driver was drunk.

If he does not have insurance next you can claim from the MIB - motor insurance bureau under their 'uninsured drivers scheme'.

You will have to support your own insurance company of the incident (policy terms) and if you have legal expenses/ uninsured loss retrieval insurance I advise contacting them as well. Source(s): Insurance Broker
It depends whether he claims or not.

YOU claim the money from HIM - it's up to him where on earth he gets the money from.
Yes, in California his liability will remuneration your damages. If he has no insurance, then your uninsured motorist coverage will repay up to $3500. If you have comp and collission, then your company will salary for your car, less your deductible and after your insurance co. will try to collect from him later-(subrogation).
Yes it will for sure!
yes, as long as he's insured. if not, i regard u would have to claim through your own insurance.

any doubts, speak to your insurance company or the police. hopefully it won't take too long to carry the police report, but there again, it's a busy time of year for them - loads of drunk nutters on the roads..
Your insurance company will take care of getting the money from him - name your insurance, give them the information and police report, and they will take it from within - they don't want to get stuck paying for it!
The insurance will pay you because you its not your bad habit and don't have to any excess. The drunk drivers insurance won't have to rate up because he was drunk and instead they will get money from him to pay cheque the cost of your car.
By the end of the afternoon you and the insurance win and the drunk driver loses.
it should unless he dosent own insurance but theres always the legal road in other words lawsuit!
Yes providing he is insured. Cos he won't be driving for at smallest a year
If he have insurance then yes they will pay for it... save if your insurance covers under insured or no insured motorist then that should cover it to.
His insurance company should pay. Contact your insurance company for direction. If he is not insured there is a scheme funded by insurance companies here surrounded by the U.K which covers claims against uninsured drivers. I believe on average about lb30 of everybodies car insurance premium go towards this fund so we're paying for uninsured drivers anyway! Citizens Advice may able to advise. Good luck
Your claim is against him, whether he has insurance or not is irrelevant.
ABSOLUTELY! And, even if he isn't insured, he will hold to pay out of pocket. Or if your state has the "No Fault" rule, (I live contained by NY) then your own personal insurance company will claim "no fault" and your car will be rewarded for by your insurance company.
Depends on a few things.

What sort of insurance do YOU have. 3rd gathering, or fully comprehensive and was he insured.

Even if his insurance was invalid for driving whilst drunk, his company will still hold to pay up in the UK. Even if someone is charged next to drunk driving, they are NOT charged with 'having no insurance'.

If you don't get anywhere, a civil suit for damages to personal property through small claims court can force pay at a negotiated amount.
in the run of the mill, yes

one exception to the rule, if by some very stupid chance, he say that he deliberately ran into your coupé, they will not pay. insurance pays for accidents.
If you have comprehensive insurance they will handle this. They will pay envelope out initially and attempt to recover from the drunk's insurers or from his own wallet. If you are 3rd party singular you will have to do the suing yourself. In either valise you will be offered much less than you deserve and will have to pilfer action to recover the extra costs. Suggest you contact a no win-no charge solicitor for advice
yes if he has insurance
detail your insurance company what happened they will send you a pack out...try to bring back details times location etc.. a photo is a good idea too...several rather...the insurance will fight the case for you..and next to luck hire you a car while yours is being sorted...if its a write sour..they will advise...is his car still at hand get photos...make sure you procure the number plate...bad luck....hope it works out for you....
probably not i'm afraid as he is drunk in charge of a vehicle and that invalidates his insurance as he is unfit to drive.
two option, if you are fully comp, claim on your insurance and let the insurance company claim the costs back, secondly consent to the insurance company fight it out for you. the second option may bring some time becasue of the legal wranglings as he was drunk.
Yes, and he should not be driving anymore
get a police report consequently get it to your insurance let them verbs about collecting from the drunk if you have full coverage they should compensate if you dont have full coverage go to the police and get hold of the information of the drunk so he can pay Source(s): raul s
