Can i sue him since he doesnt enjoy sports car insurance?
My boyfriend was driving my car christmas eve and 16minutes aftr dropping me bad he got hit by another driver. My boyfriend was slightly injured and be transported to a hospital. The police report was just completed and I'm finding out today that the guy have zero insurance. My rental bill is over a thousand already and my insurance won't cover it. Can I sue the other driver?
Answers:
Start by asking him to reward for your losses. If he refuses, you have the right to sue, but doing so might be throwing money away. Evaluate first. Does the at knock person have anything worth taking and selling? Usually those in need insurance don't have much else, or they would have insurance.
I decision you well.
No. Your insurance company will repair your saloon and sue him, they have the sole right to subrogation. He cannot be sued by you for damage salvage for the same accident the insurance company is suing him for. If you didn't purchase loss-of-use coverage, consequently you have indicated you were prepared to live short a vehicle for a while, in which case the rental of a vehicle would be classed as a personal choice by the court anyway. You can ask your insurance adjuster if they will append a month's rental to the suit, but, since you had no coverage in place for it, I doubt they will, or even reasonably can.
Sorry.
All those that say go ahead and sue should read their policy wordings. Your policy assigns rights of subrogation to the insurance company. That process they have the right to sue for any and all damages they reward out as per the policy, not you.

If your claim is handled under uninsured motorist cover, it doesn't business that the other driver has no insurance, that is what the uninsured motorist cover is for. Your insurance company can still sue him, probably have already, and you are not part of that action. If they draw from a judgment now, for damages rewarded out, and he comes into any money in the future, they will collect. If he never comes into money, they won't.
You can sue and win but what will you get. Probably nothing because he probably don't enjoy any money. Then you will have to pay your legal representative out of your pocket.
Sure. The only problem is that if he didn't enjoy insurance, he'll never pay the judgment that a settle orders. Sorry. Source(s): 22 years in the coup¨¦ business.
