What would ensue if you get into a motor wreck didn't report it to your insurance company?

My little brother 19 years old. Got into a wreck a week ago. He called the cops when it happen and exchanged information with the other driver. He never called his insurance company to report it. Today he get a letter in the communication saying because he never reported it his insurance company will not pay for anything. Can the other drive sue him? Could he be arrested?

One condition of the insurance contract (and that's what it is) is that the insured must report all claims or accidents credibly soon; your little bro didn't do that, and the company is within its rights to deny coverage. Yes, he can be sued, whether the wreck was his failing or not, but any defense in on his dime, since the company won't go to court for him. It would own if he'd reported it.
I never hear of an insurance company refusing to cover a claim because they were not notify. ....Except..... if the insurance company can no longer investigate the situatiuon, because the damage has be altered or the facts that would have been present and available are no longer present or available and it craft it impossible for them to determine the facts............. Most insurance companies require notification within 3 days. Although this seems cheap, it could probably be used within court.
