If the law say that you either get insurance or hold to pay a fee, and you do neither, after what would you suggest other than a misdemeanor?
If you are going to make something tenet, you have to build in punishment for not following the regulation. That punishment is a fine. If you fail to pay that fine, you own committed a misdemeanor.

Every one would close to to have insurance. People don't have insurance because they can't afford it. They aren't going to know how to afford to pay this fine either. Put them within jail? Punish them for being poor.
