Automobile insurance problems?

I was plowed into by a car going at 40 mph while I be wating for someone to turn right. The police report makes it clear this person be at fault+gave them a ticket! Also, I am injured. I am being told that I can't collect insurance from them unless the driver tells them it be his fault! Is this a joke? This be a young kid and I think he might enjoy been impaired also. Does he own to say it was his denounce when the police report is so clear?
Answers:
The other party's insurance company will complete their liability investigation. They consider your statement, his statement, the police report and the point of impact to your vehicle. If you were stopped, and the other party hit your stopped vehicle, I see little source why the insurance company will deny your claim or find you even minimally negligent.

You need to remember that the claims adjuster handling the claim, is a trained professional and know how to assess liability. Their insured can deny liability, but that does not mean that he was not responsible for your damages.

FYI - If you live surrounded by a No-Fault state, you probably have PIP coverage which will reimburse you for your medicals. You inevitability to file a claim against your own coverage for the payment of your meds and lost wages, if any. Your insurance company will afterwards subrogate against the at-fault carrier. You may or may not be entitled to monetary compensation for your injury. It depends on what state this loss occurred surrounded by and the threshold eligibility requirements.
