My Auto ins. mistakenly sent me an Insurance check for an misfortune that happen something like 3 years ago?

I was in two moderate accident around that time(other parties fault) so I assumed it was an settlement from one of those two-it be for $1200.00.I did not think twice. I spent it. on engine work. The Ins. co. now tell me it was a mistake and they want immediate full repayment. I offered installment payments, but they refuse and threaten legal behaviour. I can not afford this-I am self employed.What options are there?What if I dispatch them what I can afford, when I can? It was their mistake and I did not know it was a mistake.They notify me 1 1/2 months(2 days ago) after issuing the check-I live in Houston, TX- need answers ASAP.

If they made the mistake , and sent no explanation , afterwards you thought it was money still owed to you , since it was the other party fault , they may try to intimidate you , but you don't owe them , don't offer them anything , they really can't do anything , they probably owed you more than they remunerated at the time anyway . There is no legal action they can embezzle , it was an insurance settlement , tell them to stop harassing you or you will beckon your Attorney & it will end up costing them more than the $1200 , they will stop . 6 Weeks after you received the check , they want it back ? Yep, you don't have tons options here. They sent you a check in error, and you cashed it. A provision of your policy is that you transport them any money they send you by mistake.

They will take you to court, and bring back a judgement against you - and likely also cancel your policy.

Can't assume anything . . . if you, as a self employed creature, accidentally sent out a check for a bill with an extra zero at the ruin, I'd bet you would want that back, too.

Plus, it's the *right* thing to do.

Here surrounded by Houston, you can pick up a part time job or an evening charge, when you're not working your self employed business, and within a month, if you knock yourself out, you'll enjoy the money to pay them back.

I'm not sure why they wouldn't let you pay installments though... once the directory is transferred to their subrogation dept., they will probably be more inclined to work with you on that.
